There are many misconceptions people have about hiring someone to provide expert witness testimony. TV shows and movies have provided some fallacies about expert witnesses and what they do. While many of these programs have portrayed witnesses correctly and incorrectly, many still have false information. Here are three myths that people tend to think about expert witnesses and their role in a court case.
1) “Just by hiring an expert witness, I’ll win my case.” - This definitely isn’t true! While retaining an expert witness testimony might help your case significantly, it doesn’t guarantee a win. There are many factors that should be looked at when hiring an expert. So simply hiring one doesn’t automatically give you a win. Remember: expert witnesses are just there to help your counsel explain the evidence in your case. There are plenty of other influences, besides having an expert, that determine the fate of your case.
2) “If I hire more experts, the better off I am.” - Quality over quantity here. Hiring an expert witness who has a lot of experience is definitely more beneficial than hiring multiple experts. Only hire multiple experts if your counsel recommends or if your expert who you already retained found something out of their scope of expertise. Just because you’ll present more expert witness testimony, doesn’t mean your case is more credible.
3) “I only need an expert if my case is significant.” - Expert witness testimony can be used for any case, big or small. Witnesses can be beneficial because they explain complex evidence to a jury to help them understand the case better. Experts who can clearly explain their findings hold a jury’s interest and are looked more favorably upon. It is totally up to you and your legal counsel if you should hire a witness. Just remember that witnesses need time with your legal counsel and the findings of your case to prepare. So last minute work on a huge case will not help your case, no matter how significant.
